Item 7.01 Regulation FD Disclosure
As previously reported, on July 23, 2023, AppHarvest, Inc. (the “Company”) and its debtor affiliates (together with the Company, the “Debtors”) filed voluntary petitions for relief under Chapter 11 of Title 11 of the United States Code in the United States Bankruptcy Court for the Southern District of Texas (the “Bankruptcy Court”), thereby commencing chapter 11 cases for the Debtors (the “Chapter 11 Cases”), which are being jointly administered under Case No. 23-90745.
On October 23, 2023, the Company filed its monthly operating reports (“Monthly Operating Reports”), with the Court for the reporting months ended July 31, 2023, August 31, 2023 and September 30, 2023. A copy of each such Monthly Operating Report is attached hereto as Exhibit 99.1, 99.2 and 99.3, respectively.
On October 23, 2023, AppHarvest Operations, Inc. filed its Monthly Operating Reports, with the Court for the reporting months ended July 31, 2023, August 31, 2023 and September 30, 2023. A copy of each such Monthly Operating Report is attached hereto as Exhibit 99.4, 99.5 and 99.6, respectively.
